1. Acceptance of Terms
By using the Betinna.ai platform, the user declares that they have read, understood, and fully accepted these Terms.
Use of the platform is permitted only for individuals who are considered of legal age under the laws of their country of residence.
The platform is available in every country except for residents or companies based in the United Arab Emirates, whose access is expressly prohibited.
2. Responsible Entity
The Betinna.ai platform is operated by Betinna Technologies Free Zone Limited Liability Company.
3. Account Registration and Verification
To use the platform, the user must provide truthful and up-to-date information, including but not limited to full name, valid email address, phone number, and government-issued identification applicable to their country of residence.
Account activation requires validation through a link sent to the registered email, which will also include the Terms of Use and other applicable rules.
The user is responsible for keeping their login credentials confidential.
4. Plans, Trials, and Payments
Betinna.ai offers the user a free seven (7) day trial period.
After the trial, the service becomes paid (pay to use) once the user subscribes to the chosen plan.
Accepted payment methods include credit card, PIX, and bank slip.
Renewal notifications: the user will be informed by email and WhatsApp two days before, one day before, and on the day the free trial ends.
If payment is overdue after plan subscription, access will be suspended immediately, and data will be stored for up to thirty (30) days, after which it will be permanently deleted.
If the user only uses the free trial without subscribing to a plan, no data will be stored after the trial ends.
There is no refund policy because the free trial is provided for prior evaluation of the platform.
5. Responsibilities
User
- Use the platform in compliance with the laws of their country of residence;
- Ensure the accuracy of the information provided;
- Be fully accountable for any use of the platform under their account.
Betinna.ai
- Provide access to the platform according to the subscribed plan;
- Adopt appropriate technical and organizational measures to protect data against unauthorized access, loss, destruction, or improper alteration;
- Offer support as described in these Terms.
6. Misuse
It is strictly forbidden to use the platform for illegal activities, including but not limited to fraud, spam, money laundering, pornography, or any practice that violates local or international laws.
Failure to comply with this clause authorizes Betinna.ai to suspend or immediately terminate the user's account.
7. Data, Storage, and Deletion
User data will be stored only while the account remains active.
If the account is cancelled or becomes delinquent, data will remain stored for up to thirty (30) days and will then be permanently deleted.
Users may request data export during the account validity period by using the contact form at betinna.ai/en/contact.
Data sharing occurs exclusively with payment gateways for billing purposes.
8. Privacy and Data Protection
Betinna.ai complies with Brazil's General Data Protection Law (LGPD) and the United Arab Emirates Personal Data Protection Law (PDPL).
Data processing is carried out solely to deliver the contracted services.
9. Intellectual Property
All software, trademarks, logos, code, design, and other platform elements belong exclusively to Betinna.ai.
Content produced or uploaded by users remains the exclusive property of its creators.
10. Support and Service
During business hours (Monday to Friday, 8 a.m. to 6 p.m. BRT), support is provided by human agents.
Outside business hours and on weekends, support is handled by artificial intelligence.
If the AI cannot resolve the request, the ticket will be forwarded to a human agent on the next business day, with a maximum response time of twenty-four (24) business hours.
No specific support SLA is guaranteed.
11. Changes to the Terms
Betinna.ai may change these Terms at any time.
Users will be notified of changes via the platform, email, and official channels.
12. Disclaimer and Liability Limitation
Betinna.ai is not responsible for failures, downtime, or interruptions caused by external factors such as internet instability, cyberattacks, or issues with the external servers used (VPS).
In any event, Betinna.ai's financial liability is limited to the amount actually paid by the user during the previous three (3) months of platform use.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Arab Emirates, including the Personal Data Protection Law (PDPL). The courts of the United Arab Emirates are chosen to settle any disputes.
